• MO-TIQUE: Webshop (private company)
• Buyer: Each party which make a purchase at the MO-TIQUE webshop.
1: Applicability
These conditions apply to all Mo-tique shops to be met and entered agreements to buy and supply of products via the Internet.
MO-TIQUE reserves the right from time to time to modify or supplement these terms and conditions.
2: Offers / agreements
All quotations of all products are without any obligation and while stocks last.
All prices are expressed (in € for the EU and including VAT) (in US $ for all other countries and excluding VAT) and excluding any shipping and handling costs.
The agreement comes after an order of mandate of the customer.
Information, graphics, communications etc. regarding the products are as accurate as possible. The customer must, however, take into account minor differences in performance, size and color of the displayed products. Pictures and other information are only for reference.
3: Payments
Orders through this web site can be paid in the following methods. You will be linked to the secured website of our payment provider "triple deal". They will process the secured payments.

4: Shipping
Shipping and handling charge.
We don't charge freight costs on orders delivered through our dealers inside the Benelux.

5: Supplies
Because most products, offered on our Internet site, are service sensitive, we recommend you to pick up your order at a Mo-tique dealership. These dealers are familiar with the installation of quality products such as ours and will be provide you with excellent service. However we also are able to send your order directly to your home or other shipping address of your choice. (outside the Benelux only)
To compliment your order you should appoint a Mo-tique service dealer.
All orders will be sent at your own risk within 2-3 working days after the receipt of your payment. It is not possible to give you a fixed delivery date or time. Orders are processed Monday-Friday 9.00 am and 5:00 pm. Please remember that orders are sent from The Netherlands which is located in the CET (Central European Time Zone).
The customer has no right of rescission of the Agreement, unless supply is not provided within 30 days.
If compliance is impossible because the purchased product is not available, the customer will be informed as soon as possible and he is entitled to a refund of the amount paid for the non-deliverable product. The refund will be forthcoming as soon as possible and in any event within fourteen days after the notification takes place.
6: exchange and returns
If the product purchased is not as described you must inform Mo-tique within 14 working days.
If it has been demonstrated that the product does not conform as described, MO-TIQUE has the choice to return the product and replace the purchased item with new product or refund the invoice value of the item in question. If the mistake with the item to be returned is MO-TIQUE's we will pay to have the item returned to our customer service location.
If it is determined that the problem is do to customer error the customer is responsible for the cost of returning the product to our customer service location.
You may return any unused and unaltered item(s) within 7 working days for an exchange or a full refund. Authorization is not necessary; however, an e-mail to our Customer Service and Support may help you avoid an unnecessary return. Customer Support can be reached by phone or through our free chat service.
Mo-tique is only obliged to honor a refund request if the following items are met:
(i) the original purchase invoice, and
(ii) the unused and undamaged Product, and
(iii) the original packaging of the Product.
This should preferably be returned to the indicated Mo-Tique service dealer, or to be send to:

Mo-tique reserves the right to refuse the returned products or to credit only a part of the amount already paid, where it is suspected that the product has already been opened, used , or is damaged (other than those of Mo-tique or supplier of the product). Mo-tique has the right to reduce the value of the product as a result of such damage on the refund amount, if a product is returned that in the view of Mo-tique and whether the supplier of the product damage has been issued to an act or omission of buyer.
7. Privacy
How much information must you provide?
The amount of information you provide depends on you. Mo-tique uses the information you provide to secure your order and to personalize your visit to Mo-tique.com.
What information is stored?
We receive and store information you enter on our web site. For example, we collect information you provide when placing an order. This information would include: your name, mailing address, billing address, email address, your phone number, along with other information you submit. (eg. vehicle make, year) Your personal data, as required by the order, will be carefully and discreetly stored by MO-TIQUE.
What about Cookies?
Cookies are small pieces of information that are stored on your hard drive. This enables our systems to recognize who you are. Our cookies do not contain any personally identifying information. Some information collected or stored via cookies includes purchases; stored items in your shopping cart. Your browser allows you to reject cookies and software is available from third parties which will allow you to visit our web site without providing this information. You are welcomed at our web site if you use this software but we will not be able to offer you our personalized services.
Does Mo-tique share the information it receives?
We occasionally make our database list available to carefully selected marketing partners whose products may be of interest or benefit to you. We will not share any telephone number(s), or financial information which you have given us with any marketing partner(s).

In case of force majeure MO-TIQUE nor its customers are liable for not abiding by their respective obligations in the sale and delivery or purchase of items from the MO-TIQUE website. Force majeure can be caused by but limited to the following: strikes, riots, war, insurrections and terrorist activity or by Act of God such but not limited to floods, earthquakes and storms.
9 Applicable law
On all bids made by us and all our agreements apply only under the Dutch law.
10 Dispute
Buyer may report complaints to us via e-mail info@mo-tique.eu. We will seek to resolve any complaint as soon as possible.
